Terms of Service

These Terms of Service govern your access to and use of Goose and the related web experiences that link to these terms (collectively, the "Service"). The Service is operated by BandWith Inc. ("BandWith," "we," "us," or "our").

By accessing or using the Service, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the Service.

Who these terms apply to

These terms apply to anyone who visits, browses, signs in to, or otherwise uses the Service. You may use the Service only if you can form a binding agreement with BandWith and your use complies with applicable law.

If you use the Service on behalf of an organization or another person, you represent that you have authority to bind that party to these terms.

The Service

Goose is a fan platform that may include accounts, profiles, live stream playback, archived media, releases, search, event-entry experiences, TV device linking, and community features such as attendance, bookmarks, chat, and reactions.

We may add, remove, suspend, or modify features at any time. Some features may be available only in certain regions, to certain users, or subject to eligibility requirements, entitlements, or supplemental terms.

Accounts, access, and verification

Some parts of the Service require an account. When you create or maintain an account, you must provide accurate and current information and keep your login credentials secure.

  • You are responsible for activities that occur through your account.
  • You may not share your account in a way that circumvents access controls or feature limits.
  • We may require account completion or verification steps, such as email, phone number, display name, or avatar verification, before certain features are available.
  • We may suspend, limit, or terminate access if we believe account information is inaccurate, the account is compromised, or the account is being used in violation of these terms.

Access tiers, entitlements, and feature limits

Different content and features may be offered on different access tiers. Some releases, streams, replays, or other experiences may be free, some may require authentication, and some may require a separate entitlement, invite, or other approval.

Access can change over time. We may limit or revoke access to content or features if an entitlement expires, a replay is unpublished, a device session ends, an event closes, or we reasonably believe access was obtained or used improperly.

User content and community features

The Service may let you create or make available profile information, attendance, bookmarks, chat messages, reactions, guest details, event-entry information, and other material you submit through the Service ("Your Content").

You retain ownership of Your Content, but you grant BandWith a non-exclusive, worldwide, royalty-free license to host, store, reproduce, adapt, display, distribute, and otherwise use Your Content as needed to operate, improve, moderate, secure, and promote the Service.

You represent that you have the rights needed to submit Your Content and that doing so does not violate law or the rights of others.

Community standards and prohibited conduct

You may not use the Service to abuse, disrupt, or harm the Service, BandWith, or other people. Without limiting the foregoing, you may not:

  • post unlawful, infringing, defamatory, fraudulent, obscene, abusive, hateful, or privacy-invasive content;
  • impersonate another person or misrepresent your affiliation, identity, or access rights;
  • scrape, crawl, copy, reverse engineer, interfere with, or attempt to bypass security, authentication, moderation, rate limiting, entitlement, or device linking systems;
  • introduce malware, spam, automated abuse, or any activity that could disable, overburden, or impair the Service;
  • use the Service to harass others, evade moderation, or misuse community features such as live chat, reactions, profile activity, or event-entry workflows; or
  • use the Service or its content for unauthorized commercial exploitation.

Moderation and enforcement

We may monitor, investigate, remove, restrict, edit, or refuse content or activity if we believe it violates these terms, creates risk for the Service, or is otherwise objectionable. We may also mute users, revoke device sessions, remove chat messages, disable access to specific features, or suspend or terminate accounts.

We are not required to monitor every part of the Service or every interaction, and we are not responsible for content supplied by other users.

Third-party services and links

The Service relies on third-party providers for infrastructure, communications, analytics, media delivery, and security. The Service may also link to or embed third-party sites, products, streams, or services.

Your use of third-party services is governed by those third parties' own terms and policies. BandWith is not responsible for third-party services, offerings, or content that we do not own or control.

BandWith intellectual property

The Service, including its software, design, text, graphics, branding, audiovisual materials, compilations, and other content we make available, is owned by BandWith or our licensors and protected by applicable intellectual property laws.

Subject to these terms, we grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Service for your personal, non-commercial use. Except as expressly allowed by law or these terms, you may not copy, modify, distribute, sell, sublicense, publicly perform, or create derivative works from the Service.

Feedback

If you send us feedback, ideas, or suggestions about the Service, you grant BandWith a worldwide, perpetual, irrevocable, royalty-free license to use that feedback without restriction or compensation to you.

Termination

You may stop using the Service at any time. We may suspend or terminate your access, delete or disable accounts or sessions, or discontinue all or part of the Service at any time, with or without notice, to the extent permitted by law.

Sections of these terms that by their nature should survive termination will survive, including sections relating to ownership, licenses, disclaimers, limitations of liability, indemnity, and dispute-related provisions.

Disclaimers

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, BandWith disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and reliability.

We do not guarantee that the Service will be uninterrupted, secure, or error free, or that content, playback, replays, search results, device links, event entries, or community activity will always be available, complete, or accurate.

Limitation of liability

To the fullest extent permitted by law, BandWith and its affiliates, officers, employees, contractors, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, goodwill, data, content, or use arising out of or related to the Service or these terms.

To the fullest extent permitted by law, BandWith's total liability for claims arising out of or relating to the Service or these terms will not exceed the greater of one hundred U.S. dollars (US$100) or the amount you paid us, if any, for the specific Service giving rise to the claim during the twelve months before the event giving rise to liability.

Indemnity

To the fullest extent permitted by law, you will defend, indemnify, and hold harmless BandWith and its affiliates, officers, employees, contractors, licensors, and service providers from and against claims, liabilities, damages, judgments, losses, and expenses, including reasonable attorneys' fees, arising out of or related to Your Content, your use of the Service, or your violation of these terms or applicable law.

Changes to the Service or these terms

We may modify the Service and these terms from time to time. If we make material changes to these terms, we will post the updated version here and update the "Last updated" date above. By continuing to use the Service after changes become effective, you agree to the revised terms.
